What is included in a Land Registry Official Copy?

An Official Copy of the Title Register confirms who owns a property, any mortgages or charges registered against it, and any rights, restrictions or covenants affecting the Title. An Official Copy of the Title Plan shows the general boundaries of the property by reference to the Ordnance Survey map. These documents are the starting point for any property transaction.

What searches do I need when buying a property?

The searches required will depend on the property and its location. A standard search pack typically includes a Local Authority Search (planning, highways, enforcement notices), a Drainage and Water Search, an Environmental Search and, where relevant, a Mining Search, Chancel Repair Search, HS2 Search or Flood Risk Report. We advise on which searches are appropriate for each transaction.

How is Stamp Duty Land Tax calculated?

SDLT is calculated on a sliding scale based on the purchase price of the property. Different rates apply depending on whether the property is residential or commercial, whether the buyer is a first time buyer, and whether it is an additional property. We provide clear SDLT calculations and advise on any available reliefs before exchange of contracts.

What sort of property matters do you handle?

We handle restrictions, easements, restrictive covenants, statutory declarations, deeds of variation, deeds of grant, and Land Registry applications.

Do you do residential conveyancing?

No. Hayhills focuses on commercial and standalone property advisory work, not volume residential conveyancing.

What is the difference between freehold and leasehold?

Freehold means you own the property and the land indefinitely. Leasehold means you own the right to occupy for a fixed term under a lease, usually with obligations such as ground rent or service charges.

How long does a typical property purchase take?

A straightforward transaction often completes in around eight to twelve weeks, but timescales depend on searches, mortgage arrangements and the length of the chain. We keep you updated throughout.

What is the difference between exchange and completion?

At exchange the contract becomes legally binding and a completion date is fixed. At completion the balance of the price is paid and ownership and keys pass to the buyer.

Do I need a survey before buying a property?

A survey is strongly advisable so you understand the property's condition before you commit. The level of survey should reflect the age, type and condition of the property.

What is a restrictive covenant on a property?

It is an obligation in the title that limits how the land can be used, such as restricting building or business use. We check covenants and advise on their effect before you buy.
